Feb. 5, 2016:


Program Title: Hold That Appeal: Paring Back the Doctrine of Equitable Mootness

Presenter: Henk Taylor, Esq. Ryan Rapp & Underwood PLLC


Program Description: In In re Transwest Resort Properties, Inc., 801 F.3d 1161 (9th Cir.  2015), the Ninth Circuit continued a trend of recent appellate court decisions narrowing the doctrine of equitable mootness as it applies to appeals of plan confirmation orders in Chapter 11 cases.  Learn why courts are second-guessing this judge-made doctrine and taking a harder look at motions to dismiss appeals for mootness.  Discussion will include a review of the more nuanced approach courts are taking in applying the doctrine, including examples of plan objections that are likely to be heard on the merits as well as those that will continue to be dismissed on mootness grounds

Program Title: Why Darth Vader is Not Entitled to a Discharge

Program Description: This seminar will explore both procedural and substantive issues surrounding attempts to discharge debt in the unfortunate case of Mr. Vader. The seminar will provide a general overview of objection to claim discharge and objection to discharge under 11 U.S.C. §§ 523 & 727; Timing of complaint; Amendments; Res judicata/claim preclusion; Hypothetical debtor spouse; elements of proof; and case update in the area.

Program Title: Death & Bankruptcy: The Intersection of Bankruptcy and Inherited Beneficiary Interests in Trusts

Presenter: Mark Bregman, Esq, Dyer & Ferris, LLC


Program Description: This program will examine how the Arizona Trust Code affects a debtor’s present or contingent interest in assets held in estate planning instruments.  The program will also touch on other interesting tidbits about interests in inherited property.

Program Title: How Mean is the Means Test?

Presenter: Scott Hyder, Esq., Law Office of Scott Hyder, PLC


Program Description: The bankruptcy means test is a cause of headaches for many attorneys.  This program will examine how the means test is applied in Chapter 7 and Chapter 13 filings as well as common issues and mistakes to avoid.  The program will walk participants through how to calculate income and determine what classifies as above median or below median, and identify what to do if your client fails the means test.
