MCBA Trial Skills Institute provides litigators with the chance to get real
world trial experience and feedback in an intensive, single-day CLE. This year’s Trial Skills Institute on Saturday,
September 27, 2014 will have participants receive classroom instruction and
then try an employment discrimination case from a prepared case study. Participants
will make opening statements, conduct and defend direct and cross examinations
of the Plaintiff and the Defendant’s manager, and give closing arguments. Faculty including judges of the Superior Court of Arizona will preside over
each mock trial and provide one-on-one feedback to each attorney.
will be provided the case study materials in advance of the Trial Skills
Institute if they would like to prepare their case in advance, but the program
is designed to permit preparation on the same day of mock trials. The Institute will begin with a panel
discussion on trial preparation skills, followed by separate workshops for the
attorneys who will represent each side of the mock trial. The workshops, guided by experienced Arizona
trial lawyers, will permit participants the opportunity to prepare or fine-tune
their case. Attorneys will also have an
opportunity to meet with their "client” witness to prepare for the direct

During Trial.” After lunch, participants
will try their cases before the Institute’s faculty members, and receive
feedback on their performance. Each mock
trial is limited to one hour, giving each side 30 minutes to present its case. Timekeepers will help each attorney keep
track of how many minutes are remaining.
The case materials that will be provided to each attorney include a few
pages of deposition testimony for each witness, and exhibits such as a
performance evaluation and a notice of termination.
Institute is open to any active Arizona attorney, of any level of
experience. The Institute is likely of most value to inexperienced trial
attorneys, and practice group leaders looking to train associates in an
affordable manner. In making the pairings for the trials, every effort
will be made to try to match attorneys with similarly experienced attorneys. In
order to ensure one-on-one feedback, the program is limited to twenty-four
participants, so space is limited.
